This website is operated by We Feed You. Throughout the site, the terms “we”, “us” and “our” refer to We Feed You. We Feed You offers this website, including all information, tools and services available from this website and any (information, tools and services including but not Limited to): newsletters, social media, images emails, online chats and telephone calls to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
By visiting our site and/ or purchasing meals from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.
Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.
Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

SECTION 1 - ONLINE STORE TERMS
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state of residence, or that you are the age of majority in your state of residence and you have given us your consent to allow any of your minor dependents to use this site.
You may not use our products for any illegal or unauthorised purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
You must not transmit any worms or viruses or any code of a destructive nature.
A breach or violation of any of the Terms will result in an immediate termination of your Services.
SECTION 2 - GENERAL CONDITIONS
We reserve the right to refuse service to anyone for any reason at any time.
You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
By ordering via our site, it is your responsibility to ensure the information you provide is current, up to date and all relevant fields are completed. In some circumstances for us to successfully process your order, we may require you to verify information or provide additional information, instructions or details.
SECTION 3 - ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION
We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk. For example, any nutrition information is not medical advice, it is of a general nature only and you need to seek advice from your general practitioner or seek a referral to an Accredited Practising Dietitian for nutrition advice specific to your needs.
This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.
The meals are designed for adults and are not intended for use by children under the age of 18. We recommend you consult your general practitioner or other suitably qualified health professional before commencing any new diet or eating plan.
No information provided by We Feed You is medical advice, diagnosis or treatment plan. We do not assume any liability for the content of any material provided by We Feed You or our affiliated partners or companies.
At We Feed You, we strive to provide timely responses to emails and phone calls within 24 hours during business days. However, due to the small nature of our business, there may be occasions when our response time extends to 48 hours or more. We appreciate your understanding and patience as we work diligently to address your queries.
SECTION 4. FOOD ALLERGY & INTOLERANCE DISCLAIMER
We Feed You takes food handling, labelling, safety, allergies and intolerances very seriously. We Feed You also attempts to provide accurate nutrition information for our products and share ingredient information as it appears from a supplier. We Feed You use a number of products in our kitchen which many people are allergic to and may be at risk of cross contamination. Customers with food allergies and intolerances need to read the nutrition and ingredients information carefully and consumption of these meals is at their own risk.

SECTION 5. FOREIGN OBJECTS
We Feed You purchases preprepared ingredients from third party providers such as pre-pitted olives or pre-washed fresh herbs. Whilst our chefs endeavour to look out for foreign objects such as bones in pre-boned meats, pits in pre-pitted olives or grit in fresh herbs to double check the removal of these items as purchased, human or machine error can occur at the site of manufacturing - as it can at home and we do not take responsibility for these items appearing in our food.
SECTION 6 - MODIFICATIONS TO THE SERVICE AND PRICES
Prices for our products are subject to change without notice.
We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
Our small team strives to accommodate a variety of needs, but we may not have the capacity to provide specialised or extensive support for all requests. If you require services that exceed our scope or resources, we regretfully may be unable to fulfill your request and have the right to cancel or not full fill services at any time. We encourage you to seek specialised providers who can better meet your unique requirements.
We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.
SECTION 7 - PRODUCTS OR SERVICES
Certain products may be available exclusively online through the website. These products may have limited quantities and are subject to return or exchange only according to our Return Policy in section 10.
We have made every effort to display as accurately as possible the colours and quality of our food that appear in the store. We cannot guarantee that your computer monitor's display of any colour will be an accurate representation of our products.
We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.
We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.
SECTION 8 – FEES AND CHARGES
By ordering on www.wefeedyou.com.au you agree to pay the following fees and charges:
- The stated purchase price of products added to your cart, note minimum orders sizes must be meet for order to be accepted and delivered
- The delivery fee which may vary depending on your delivery postcode and may be free of charge depending on your cart total
- GST applies where applicable at the checkout
- Any other fees and charges which may apply to your order but will be stated at the checkout before payment is made
The online purchase price may vary for each customer due to our We Feed Rewards program. These online prices at www.wefeedyou.com.au are not negotiable and may be different to what appears in retails stores, supermarkets or other online sites across Australia. We cannot dictate the price to our wholesale clients. Therefore, we do not participate or enter into any discussions about price matching.
SECTION 9: PROMOTIONS, DISCOUNTS, GIFT VOUCHERS AND LOYALTY PROGRAM
We Feed You run discounts, promotions, free product offers and other marketing events from time to time and can be changed in anyway or withdrawn at the discretion of We Feed You. They are offered in good faith and all other terms and conditions apply. Discounts and promotions cannot be used in conjunction with any other offer, gift voucher or Rewards Program.
Some NDIS and other support agency customers (as agreed in writing) are not able to apply for additional discounts and offers due to their unique ongoing Gold We Feed rewards membership and/or agreed prices as per quotes issued. Exemptions may apply to self managed participants who can order directly online and request an NDIS receipt when ordering.
Onus is on the customer to apply any discount code at the checkout and cannot be applied retrospectively. Discounts apply one use per customer and cannot be used by the same customer multiple times using false names or contact details. If a customer ignores and proceeds under a false alias or multiple contact details they will be asked to pay the full amount of the order and sent an invoice prior to the order being fulfilled, have their order cancelled and may also be banned from the We Feed You website.

Gift vouchers are available for purchase online and can only be redeemed online at www.wefeedyou.com.au For additional items not covered by the cost of the gift card, this must be paid at the time of purchase. Gift vouchers will be issued with an expiry date which is non-negotiable. Failure to use the voucher in the given time will result in the gift card being void.
SECTION 10. REFUND / RETURN POLICY
We Feed You is a family-owned Australian business and we pride ourselves on the consistent quality of our meals. Repeat positive feedback and orders from our customers is what keeps us going and our business thriving. Our meals are made by hand so there can be small changes in batch to batch. Whilst we aim to minimise this through clear processes and procedures, changes may occur due to the quality and variability of fresh produce from season to season.
If you are unsatisfied with your meals please reach out to us in writing at team@wefeedyou.com.au. Let us know why you are not satisfied, any relevant images, batch numbers, order number and receipt of purchase. We take feedback seriously and appreciate hearing from our customers. Due to this we have very strong relationship with many of our customers, who will reach out if they notice inconsistencies. This helps us to improve kitchen systems and procedures.
We Feed You do not provide refunds because you did not like the product, we all have different pallets and there will be meals on the menu you may not like but others love. Just like if you buy a packet of biscuits from the supermarket, they will not give you a refund because you did not like it and quite simply you make a decision not buy it again or not. We all take this risk and joy when we try something new.
We also do not provide refunds for change of mind. However, if you receive a product that is not what you ordered or arrived damaged during delivery, please contact us immediately with supporting photos to make arrangement for a return or replacement. We Feed You will decide the best option for each individual case. We reserve the right to refuse a refund or replacement if we believe the case is not genuine or breaches our policy.
For meals which have defrosted, we need proof of meals and the ice pack defrosting at the exact time of unpacking your order with proof of time (not from a watch). We will then take time to review your report with other information from our delivery partner, such vehicle temperate logs and other reports of defrosted orders from the same run. If the information does not add up, we may refuse a refund.
SECTION 11: MISSING OR REPLACEMENT ITEMS
Whilst we aim to keep very accurate stock records to minimise out of stock events, however due to unforeseen circumstances or human error, out of stock items may occur at short notice. In the event of this occurring, we will provide you with a substitute product at equal or greater value or another meal you have selected as part of your order. No additional cost will be incurred.
If an item is missing from your cart you must contact us at team@wefeedyou.com.au as soon as possible so we can check your order and the relevant packaging details in our records to rectify the situation. Once we have agreed the item was missing we will discuss options with you which may include providing a credit for your next order of equal or greater value to the item lost, arrange for the item/s to the redelivered or refund the value of the missing item – including any discounts which were applied to the order. The decision rests with We Feed You to determine to best course of action for each order.
SECTION 12 – CANCELLATION OF ORDER
We Feed You may cancel any or order part of an order even once processed, without any liability due to errors on the website which may be related to the ingredients, pricing, human error or product availability. You will be notified via email, phone or text message depending on availability and issue at the time.
The customer may cancel an order 5 business days prior to the nominated delivery date. If you have a change in plans, a delivery may be postponed to a new date at no extra cost if done within 5 business days. On some occasions we may be flexible with shorter notification and will work with you to find a solution to a delivery challenge. However, we will not accept responsibility to short notice change of plans (less than 5 days) if a reasonable solution cannot be found.
SECTION 13 – GENERAL DELIVERY OF SERVICE

We Feed You will only fulfil orders which are ordered online or via other means as agreed in writing. These deliveries will be made to postcodes within our delivery scope as specified at the time of ordering. You will also be required to choose a delivery time window and any special delivery instructions which will be shared with the delivery provider. Onus is on the individual making the order to accurately reflect the correct delivery postcode and delivery details.
We aim to meet your expectation and delivery the product in the specified delivery time, date and location however there are circumstances outside our reasonable control that may hinder, delay or cancel an order. We will not be liable for these delays and will do what we can to notify you of these occurrences as soon as possible and attempt to rectify the situation.
If no special instructions are provided the meals will be left at the nominated address and where the delivery driver deems appropriate at the time of delivery. Even if special instructions are provided, the driver may not read English or misinterpret your instructions, so it is your responsibility to keep an eye on the text message alerts to secure your order on delivery. Onus is also on the customer to enable a successful delivery.
We Feed You does not accept any responsibility for stolen, damaged or loss of items delivered on behalf of We Feed You to the nominated address.
At We Feed You, we work closely with trusted third-party delivery partners to ensure your meals arrive in excellent condition. However, due to the routing systems and operational limitations of our delivery partners, we cannot guarantee specific delivery time windows within the 7AM - 6PM or 12AM - 7AM windows.
The actual delivery time may update once the route commences but due to factors beyond our control, we cannot nominate times or windows or make any changes on the day of delivery. This is due to many factors including:
- Courier routing and scheduling changes
- Traffic delays and unforeseen logistical issues
- Weather conditions and external disruptions
- Limitations of technology
By placing an order, you acknowledge and accept that:
- Delivery windows provided are estimates, not guarantees.
- Delays or changes in timing may occur due to logistical constraints.
- We Feed You is not responsible for any inconvenience caused by changes to delivery times.
- We Feed You uses a third party delivery provider and whilst we can give feedback, we cannot control their operations.
SECTION 14 - ACCURACY OF BILLING AND ACCOUNT INFORMATION
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.
You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address, mobile phone number and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed. You also agree to provide accurate delivery instructions when ordering to avoid mis-deliveries. The onus is on you to provide this information so it can be communicated to the delivery driver.

SECTION 15 - OPTIONAL TOOLS
We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.
You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.
Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).
We may also, in the future, offer new services and/or features through the website (including, the release of new tools and resources). Such new features and/or services shall also be subject to these Terms of Service.

Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties.
We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).
We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.

We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.
You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.
You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
In no case shall We Feed You, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend and hold harmless We Feed You and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
SECTION 23 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
SECTION 24 - TERMINATION
We Feed You reserves the right, at its sole discretion, to suspend, restrict, or terminate your access to our services, website, and/or any related content at any time, for any reason, including (but not limited to) a breach of these Terms and Conditions or applicable laws, disrespectful treatment towards our team, an inability to meet your high needs which are not set up to service.
In the event of termination, you will remain liable for any outstanding fees or amounts owed prior to the date of termination. We Feed You shall not be liable to you or any third party for any claims or damages arising out of any termination or suspension of access to our services. Any provisions of these Terms and Conditions which, by their nature, should survive termination (including, without limitation, ownership provisions, disclaimers, indemnities, and limitations of liability) shall continue to apply.
SECTION 25 - ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
SECTION 28: FORCE MAJEURE
We Feed You is not responsible for any delay, damage, or failure to deliver goods caused by a Forced Majeure event. This is any act of god, nature or other elements, terrorism, piracy, civil war, insurrection, revolution or civil strife, acts of public enemies, federal or state laws. This also includes the inability to procure material, equipment or labour required to service our products. We will not be liable for any other causes beyond the control of We Feed You and will not be considered a breech of or failure to perform under this Agreement.
SECTION 29: WHISTLEBLOWER PROTECTION
We Feed You is committed to upholding the highest standards of integrity, transparency, and accountability in everything we do. We recognise the important role that whistleblowers play in ensuring the safety and wellbeing of our community — including NDIS participants, aged care recipients, employees, contractors, suppliers, and other stakeholders.
We provide clear and safe channels to report any concerns about misconduct, breaches of law or regulation, unethical behaviour, or poor service practices. This includes any issues relating to the rights, safety, or care of vulnerable people, such as NDIS participants or older Australians receiving care.
Confidentiality and Identity Protection
If you make a report under our Whistleblower Policy, your identity will be protected to the fullest extent permitted by law.
We will not disclose your identity or information likely to reveal it without your consent, except where required by law or authorised regulatory bodies such as:

ASIC, APRA, or other regulators as required.
Protection Against Retaliation
We strictly prohibit any form of victimisation or retaliation against individuals who make a whistleblower report in good faith. This includes dismissal, discrimination, harassment, demotion, or any other adverse action.
Anyone found engaging in retaliatory behaviour will face disciplinary action, which may include termination of employment or contracts.

- By phone appointment with the Whistleblower Officer.
In addition to reporting to We Feed You, whistleblowers also have the right to make a report directly to external bodies such as the NDIS Commission, the Aged Care Quality and Safety Commission, or the ACCC/ASIC, depending on the nature of the concern.
